These Terms of Service ("Terms") govern your use of Ricalcola (https://ricalcola.app), a spaced-repetition learning platform operated by LayerGarden (individual developer project). By accessing or using Ricalcola, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any part of the Ricalcola service, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the service.
2. Service Description
Ricalcola is a spaced-repetition learning platform that provides:
- Flashcard study sessions with scientifically-optimised review scheduling using the FSRS (Free Spaced Repetition Scheduler) algorithm.
- An academy of curated courses covering a variety of subjects, each containing structured topics and flashcards.
- Tools for creating your own flashcards, topics, and courses.
- Progress tracking, study statistics, and learning analytics.
3. Accounts
- You must provide accurate information when creating an account (via email registration or Google Sign-In).
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- Each person may maintain only one account. Creating multiple accounts to circumvent restrictions is prohibited.
- You must notify us promptly at privacy@ricalcola.app if you believe your account has been compromised.
4. User Content
When you create flashcards, topics, notes, or courses on Ricalcola:
- You retain ownership of all content you create.
- You grant Ricalcola a non-exclusive, worldwide, royalty-free licence to store, display, and transmit your content solely for the purpose of providing the service to you.
- You may delete your content at any time, which will remove it from our servers within 30 days.
- You are responsible for ensuring your content does not infringe on the intellectual property rights of others.
5. Academy Courses
- Academy courses published by creators are made available to all Ricalcola users for learning purposes.
- By publishing a course to the academy, the course creator grants Ricalcola a non-exclusive licence to display, distribute, and make the course available to all users of the platform.
- Course creators retain ownership of their course content and may request removal of their published courses at any time.
- Ricalcola does not claim ownership of any user-published course content.
6. Acceptable Use
You agree not to:
- Use the service for any illegal purpose or in violation of any applicable laws.
- Upload content that is defamatory, obscene, hateful, or that incites violence.
- Scrape, crawl, or use automated tools to extract data from Ricalcola without prior written permission.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any part of the service, other users' accounts, or our systems.
- Interfere with or disrupt the service or servers and networks connected to the service.
- Use the service to distribute spam, malware, or unsolicited communications.
7. Intellectual Property
The Ricalcola name, brand, logo, visual design, user interface, and underlying platform code are the intellectual property of LayerGarden. You may not copy, modify, distribute, or create derivative works based on our platform without prior written consent.
8. Termination
- By you: You may delete your account at any time from within the app or by emailing privacy@ricalcola.app. Upon deletion, your personal data and study history will be permanently removed within 30 days.
- By us: We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or pose a risk to other users or the service. Where possible, we will provide notice before taking action and explain the reason for the decision.
9. Disclaimers
Ricalcola is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that:
- The service will be uninterrupted, secure, or error-free.
- Any specific learning outcomes will be achieved by using the service.
- The spaced-repetition scheduling will perfectly match your individual learning needs.
The effectiveness of spaced repetition depends on many factors including consistency of use, content quality, and individual learning differences.
10. Limitation of Liability
To the maximum extent permitted by applicable law, LayerGarden and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of Ricalcola.
Our total aggregate liability for any claims arising from your use of the service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Italian Republic and applicable European Union regulations. Any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Italy.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users through the Ricalcola app before the changes take effect. Your continued use of the service after such notification constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page indicates when the Terms were most recently revised.
